Welcome to Lozi, a mobile-based grocery and vegetable delivery platform. These Terms and Conditions (“Terms”) govern your use of our application, services, and website. By using our platform, you agree to comply with and be bound by these Terms.

1. Definitions

• "User", "You", "Your", "Customer", "Client" refers to any individual or entity accessing or using Lozi's platform.
• "Company", "We", "Our", "Us" refers to "Lozi".
• "Platform" refers to the mobile app, website, and any associated services of Lozi.
• "Product(s)" means all groceries, vegetables, and related items listed and sold by Lozi.
• "Subscription"

2. Acceptance of Terms

By downloading, accessing, or using the Lozi app, you agree to be bound by:

• These Terms and Conditions.
• The Privacy Policy.
• Any additional guidelines or rules posted on the platform.

If you do not agree with any part of these Terms, you must not use the services.

3. Eligibility

• You must be at least 18 years old to use the platform.
• If you are under 18, you may use the platform only with the supervision of a parent or guardian.
• You must be legally competent to enter into a binding contract as per the Indian Contract Act, 1872.

4. Services Offered

• Lozi provides a digital platform to order fresh groceries, vegetables, fruits, dairy, and daily essentials.
• The services include:
• One-time purchases
• Subscription-based deliveries
• Flash deals and seasonal discounts
• Scheduled deliveries

We may modify, suspend, or discontinue any services or features at any time without prior notice.

5. Pricing and Payments

• All prices are listed in INR (₹) and are inclusive of applicable taxes unless mentioned otherwise.
• Product prices are dynamic and may vary based on supply, demand, and market conditions.
• Accepted payment methods include UPI, Debit/Credit Card, Net Banking, and Wallet payments.
• Platform Fee of ₹5 may be charged per order and is subject to refund upon meeting order conditions.

6. Subscription Policy

• Subscriptions are flexible and can be started, paused, or canceled anytime via the app.
• No delivery charges are applicable on subscription orders.
• A minimum wallet recharge may be required to activate or maintain subscriptions.
• Subscription prices may fluctuate based on market rates, except for fixed monthly packs.
• Lozi reserves the right to modify or cancel subscriptions and related benefits without prior notice.

7. Returns & Refunds

• Return Policy: Returns are not accepted. Please check the product at the time of delivery.
• Refund Policy:Refunds are issued in cases of:
• Damaged or spoiled goods
• Incorrect or missing items
• Weight discrepancies in fresh produce
• Approved refund amounts will be credited to the Lozi Wallet within 2–5 business days.

8. Communication Consent

By registering on Lozi, you consent to receive communication from us via:

• SMS
• Email
• WhatsApp
• App Notification
• Customer Support Calls

You can opt-out of promotional messages at any time.

9. Objectionable Content

While we strive for a safe environment, some content may be offensive or inappropriate to some users.

You agree to use the platform at your own discretion and report any such content.

10. Intellectual Property Rights

• All content, design, graphics, and logos are intellectual property of Lozi or its licensors.
• You may not:
• Copy or reproduce platform content
• Distribute or republish any material
• Use company data for commercial purposes without written permission

11. User Responsibilities

You agree to:

• Provide accurate and current personal details
• Maintain confidentiality of your login credentials
• Not misuse the platform or engage in any unlawful activities

12. Refer & Earn Program

• A unique referral code will be provided.
• Rewards will be granted only if:
• The referred person uses your code during registration
• Their first order is successfully delivered
• Rewards are non-transferable and expire if not used within the stipulated period.

13. Membership & Offers

• Free delivery and special pricing apply to subscription and membership users.
• Flash deals and coupons are subject to availability and may not be combined.
• Packaging charges may apply as mentioned.

14. Delivery Policy

• Deliveries are usually made within the selected time slots.
• In case of delays due to unforeseen events, we will notify you via SMS or app.
• You are responsible for receiving the order or arranging someone to collect it.

15. Termination of Services

• You may discontinue use at any time by deleting the app or account.
• Lozi reserves the right to suspend or terminate your access if:
• Terms are violated
• Fraudulent or abusive behavior is detected
• Platform misuse is suspected

16. Data Privacy & Security

• Your data is collected, stored, and processed in accordance with IT Act 2000 and Rules 2021.
• We follow industry-standard security protocols.
• You have rights to access, correct, or request deletion of your personal data.

17. Limitation of Liability

Lozi is not liable for:

• Product availability fluctuations
• Technical glitches or downtime
• Content posted by third parties
• Any indirect, incidental, or consequential damages

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes
arising shall be subject to the exclusive jurisdiction of Nalanda, Bihar.

19. Updates to Terms

We reserve the right to modify or update these Terms at any time. Users will be notified via app or email.

Continued use of the platform constitutes acceptance of the revised Terms.
